This is a bad answer. Marrying for immigration benefit is fraud.

Most of people marry because they love each other and want to build life together.

Yes I am aware and I know that's not what I am doing. Like I said earlier in the paragraph you quoted, we have been living together for a while. What I was getting at was I have more than enough documents to prove that the relationship was legit and not just for immigration - which is what USCIS is interested in correct? Not meet someone on a tourist visa and get married in 30 days. That's not what I am doing. The timing however was driven because of the uncertainty of my situation.

OK, you tell this to immigration officer.

Then he asks follow up question: "So if your employer based green card would have been approved, you wouldn't be marrying?"

What would be your answer to this?

My answer would just be what me and my spouse discussed, getting married next year irrespective of my employment based application. I don't know why you think I am not being genuine here. I have seen countless posts of people getting married within 90 days of meeting and they were okay?

I'm sure you're genuine and your marriage is bonafide. You're just framing things in a fashion that may trigger more attention from immigration. Of course, you always have to tell the truth.

Yes, we have been living together for a while, have text messages to prove how we met on a dating app. travel pictures, pictures with families, hotel reservations, etc.. The decision to marry now was ultimately driven by USCIS delay in processing my other case. So, is that a problem? If we ever get a question like "What prompted us to get married?" - is there a right answer?

I would also prodcue eveidence as joint banking, credit cards, life insurance on each other, WIlls

We never were asked what promted us to marry, we did have a Stokes interview, but lastest maybe 3 minutes ,   asked who walks the dogs? Who smokes?  and what languages does the other speak.
