Hello all,

 

I realized I am not too sure on the income and tax information still...

Me: Beneficiary, makes around 70k

Spouse: Petitioner, marriage-based, makes around 68k

Only two of us are the household members.

 

Please let me know if my understanding below is correct:

In I-864:

Individual income will be 68k. Proof will be an HR statement?

Total income is 138k or something like that, because we filed jointly and that is the adjusted gross income I see in our 1040 tax return transcript.

 

But then I included my own income to the mix, is that a problem? USCIS website says below, and not sure how to proceed:

 

If you included the income of the intending immigrant who is your spouse (he or she would be counted in Part
5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after
obtaining lawful permanent resident status.

 

Can I receive some help if you know or have applied after filing taxes jointly? I am a bit confused about how I can provide that evidence of continued work, and my spouse already makes enough. Thank you for the help, I cannot understand the process by myself at all... It would be helpful if someone also very quickly discussed what evidence/information I need for the tax purposes...

If your current work is in the USA now, you simply show the pay stub or HR letter.  If you are adjusting status, you're in the USA.  The question about current income is in the present tense.  So, the income you mention is already being earned in the USA.  Right.

 

Note that Adjusted Gross is not the correct number.  Use Total Income.  However those numbers are often the same.

Facts are cheap...knowing how to use them is precious...

Interesting, this is what I have in the final version of I-864 form, that is why I was using the "adjusted gross income" in IRS forms:

With that being said, is that correct for everyone who files taxes married-filing-jointly. I guess the answer is "sure, why not?" but I wanted to make sure...
