Hi,

I would love some advice from anyone if possible.

I petitioned for both my sons who are Unmarried and over 21. The cases became current in 2022 and all documents were submitted and approved. We have been waiting for the case to be sent to the embassy for interview. This year, I adjusted my status and became a Citizen.

I wasn’t sure how to notify NVC of that so I filled out a NVC inquiry form and uploaded my Naturalization Certificate to ask them to update my category.

Well this morning, I got an email saying the interviews were scheduled. Very happy but now I’m worried. Because on the emailed it states the preference category as Unmarried son/daughter of permanent resident.

Does anyone know what I should do? Can they still go to that interview? Would they deny them or it make them wait longer?
Do I need an immigration lawyer?

Please, if anyone has any knowledge or experience on this, that would be greatly appreciated. Thanks

Yes, they don't have to switch to F1 category, and in fact many choose not to as F2B is often quicker. They can 'opt out' of the conversion. https://travel.state.gov/content/travel/en/us-visas/immigrate/national-visa-center/immigrant-visas-processing-general-faqs.html#ivp6

As long as you've informed NVC of your change of status then that's fine - I'd suggest they take proof that you did just in case.

Good luck.
