Hi All, I recently received an RFE for my Form I-864 from my joint sponsor. There were some issues with pay stubs, etc., so I decided to find a different joint sponsor to avoid a denial in my application. 

 

Here are the main points:

- My wife (US citizen) does not meet the financial requirements, so we needed a joint sponsor

- Her brother (LPR), who lives in a different state, is going to be our new joint sponsor. 

 

I was filling in the I-864 form, and it was quite straightforward for me until I realised his tax returns had "Married taxpayer filing jointly". His spouse does not work

 

My question is, now that I know he is filing jointly, does this mean that his spouse has to provide a Form I-864a? Or can I submit just his I-864 alone, as he meets the requirements and has no additional income from his spouse?

There have been instances where a consulate has asked for an I864A from the spouse of the sponsor or joint sponsor even if the spouse is not employed particularly when the sponsor or joint sponsor files taxes jointly.  Probably best to have the spouse fill out and I864A.
