Hello,

 

My wife is a U.S. citizen. She was born in the U.S. and lived there from age 0 to 4. We have already received approval for the I-130 petition, and we are currently living outside the United States as we begin the NVC process.

 

Since we are living abroad, my wife does not currently have U.S.-based income to report on Form I-864. However, I am retired and receive a military pension of approximately $50,000 USD per year from the country we live in.

 

Can I use this pension income on Form I-864A as a household member, and do you think this will be accepted by NVC? We do not have the option of using a joint sponsor, so this is our only financial route. In addition, we have about $150,000 USD in savings (not held in a U.S. bank).

Will her income continue when she moves to the US

 

How will she be addressing domicile?

 

Joint Sponsor would be a simple solution

the income is  my pension (her spouse) and will continue until the day I die  as it’s a pension for life . We also have an official document that declare it and we will move the pension monthly to the U.S. 

 

what do you mean by addressing domicile ? She was born in the U.S. and she is the partitioner

Partitioner? I think you mean petitioner?

US born citizens living outside the US for long periods of times typically do not have domicile in the US. Domicile isn't citizenship. It's strong ties to the US showing the citizen actually resides in the US.
