Timeline

Hi guys,

Please could someone give me some practical advice. My wife (USC) and I (British citizen) filed for AOS last November (2006). At long last we have received notification that our I-130 has been approved. However, on the notification letter it states that I can now submit an I-485 however, we have already filed this along with the I-130. Therefore, 1) has the USCIS lost our I-485 paperwork?, 2) what happens next in this long drawn out process? and, 3) will they have done the background checks on me or do we have to wait for that to be completed to? If it helps we filed with the California Service Centre and our local field office is Louisville, KY.

Thanks for any advice you can offer.

I'm confused... your timeline shows that you entered on a K1 and married within the appropriate timeframe (within 90 days from entry). Why did you file an I-130?

If your I-485 has been pending since 2006, you might want to do an Infopass appointment to see what's going on.

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Thanks for the replies. Firstly, there has been no update regarding our I-485 online since it was transferred to the California Service Centre last December (2006). Secondly, we were under the impression that we had to file an I-130 with the I-485. We thought we had researched the application process extensively enough, but is this not correct? I think the idea of scheduling an infopass appointment is a very good one because we just don't seem to be getting anywhere even with the limited help my wife's Senator's office provides.

Secondly, we were under the impression that we had to file an I-130 with the I-485.

If you came on a K-1 visa and married within 90 days of arriving in the USA on the K-1 visa, then there was no need to file an I-130.

Good luck at the infopass appointment and hopefully they can tell you what's going on with your case.

Not sure if you need to do anything about the approved I-130... probably nothing.
