Gosh, five in a row -- here now is Wednesday's Semiofficial Semiweekly VAWA-Thread Joke:

THOUGHTS FOR THE DAY

 

It amazes me how much "exercise" and "extra fries" sound alike.

 

I was just prescribed some anti-gloating cream.  Can't wait to rub it in.

 

I was just minding my own business, and the next thing I know...

I'm the same age as old people.

 

I'm not OCD, but you can count on me to turn your toilet paper in the correct position.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Where are you filing it from? Where to send it depends on various factors, use this page to determine that - https://www.uscis.gov/forms/all-forms/direct-filing-addresses-for-form-i-360-immigrant-petition-for-amerasian-widower-or-special-immigrant

 

Did you tick the box in Part 10 to say you’d want an EAD? And are you in the US now?

Do you have a pending form l-485?

If yes, you may be qualified for a work permit (EAD) C9 category if you are a spouse or former spouse of a US citizen even before the approval of your form I-360.

HOW DIFFERENT PROFESSIONS MEASURE

 

How do different professionals measure the volume of a ball?

 

Mathematician:  Measures the dimensions of the ball and calculates the volume.

 

Engineer:  Looks up the volume in the ball catalog.

 

Physicist:  Submerges the ball in a beaker of water and measures the displacement.

 

Statistician:  Compiles thousands of guesses about the volume without a single answer being correct.

 

Lawyer:  Explains to you why it is legally someone else's job to calculate the volume.

 

Politician:  Tells you every statistic about the ball, from every angle, his opinions on the ball, and his opponents' opinions, but still won't answer the question you actually asked.

 

Banker:  Prefers to invest in other people's guesses about the volume and charge a commission on the profits.

 

Psychologist:  Sits with the ball for an hour and tries to get it to talk about itself and its volume.

 

Mechanic:  Doesn't care about the volume, but asks when was the last time you replaced its timing belt.

 

Economist:  Explains that the volume depends on supply, demand, and global market conditions, and predicts that it will likely change in the future.

I don't have a pending I-485. I have a VAWA I-360 to send in tomorrow. I ticked the EAD box on the I 360. I want to send in the I-360 without the the I-485 to speed up getting work authorization. I did a Google of the address to send it and noticed an email address, so I spent 6 hours converting my documents to pdf to send electronically last Tuesday only to get an email back last Friday saying I'd sent them to the wrong email address.

Yes I am a spouse of a US citizen. If I sent a I-485 with my VAWA I could get work authorization faster?

My situation right now is to get work authorization as soon as possible and is my only chance of being able to carry on living in the US as I'm broke. If not I'd have to go back home and carry on VAWA there. That would be devasting for my kids.

You should send i-485 if you want EAD faster. If you thinking to send just i-360 to get faster EAD than right now process time is 48 months which is 4 years.

I-485 has to have i-693 medical report. The last I did a medical report for I-485 it cost me an extra $500 and two trips to another city. I don't have the money or means to get there. Waiting 4 years for work authorization is a no brainer. 

My only choice is to go back home and do it from there at the US Embassy.Or forget I 360 for now until I get back home.

If I file I -360 tomorrow can I apply get permission to go back home to work. Is there a form to fill in? 

I'm thinking I could go back home, obviously work and have permission to fly and back and forth to see my kids until my green card work authorization is accepted.

If you're that broke there is one last seldom used option, but it might help in your specific case. 

 

Include an I-765 under a category code (c)(14)( ) and I-765WS (this is required for any deferred action based EAD). VAWA prima facie determination comes with a supplemental grant of deferred action. Deferred action makes you eligible for an EAD under category C14. C14 EAD for VAWA self-petitioners is free to file. PFD also is a lot faster than waiting for the I-360 to be approved.
