I started printing out forms and starting the process of doing the K1 visa and I believe I need tax returns for the last 3 years but I worked overseas and didnt pay taxes so I didnt file. Would I need to give them my W-2? Im pretty lost when it comes to paperwork like this.

Apologize in advance if this is posted in the wrong forum.

Working overseas does'nt exempt you from filing US Income Tax returns, even if the foreign income exclusion results in no taxes due. Unless your earnings were less than the amount required for filing taxes, you must file them anyway. If you were exempt from filing because the income was too low, you can so state.

You do not send tax returns with the petition. They go with the appropriate affidavit of support at a later date.

You will need this info later when fiancee interviews for visa, and when adjusting status. IRS returns are required for I-864 when adjusting status after marriage to the fiancee.

US Citizens may be exempt from paying taxes on income earned out of country, but they are not exempt from filing IRS returns every year.

File them late while you are in the process of waiting for the I-129f to complete.

Currently Im unemployed. I was thinking of asking my relative for help on the affadivit of support. Would they still need my tax returns or the person who is sponsoring me?

Thanks for the replies.

Tax returns for the USC and any joint sponsors. If you're not the USC, don't worry about tax returns.
