Traffic Tickets in I-485 & N-400

Hello!

 

My window to apply for Naturalization (N-400) under the 3 year rule is coming up. I'm still married to the same USC 3 years after green card approval. Upon coming across this community and reading some comments about traffic violations, I wanted to confirm. I answered "No" as seen below to this question on my I-485 because I thought this question was asking about criminal history. Traffic violations are civil infractions where I got the ticket outside the US (speeding 10 miles per hour over). No excuses - I answered "no" when it probably should have been a "yes".

 

  1. I plan to answer "Yes" in N-400. However, do you think this will cause an issue in good moral character because the answer in I-485 was a "No"? I do not have a criminal history. This was a speeding ticket in Year 2015 which was 10 miles per hour and fines paid OUTSIDE the US.
  2. The traffic violation occurred in Canada in Year 2015. This is a CIVIL infraction not criminal as it was just going over 10 miles per hour (15KM/HR). Canada does not usually share traffic violations especially over 8 years as it is not a criminal matter.

 

Please give me your perspectives if this oversight (ie answering "no" in I-485) will jeopardize my N-400 case once I answer "yes" to my naturalization forms. If you have experience, please share! Thanks!

It's non-US and not a big issue. Carry on. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

You should enter yes and then explain the saturation that it was a traffic citation, and you took care of it.  (If you have a copy of disposition from the court and/or have proof of payment of the fine include that in the evidence submitted) 

 

It's not going to affect your citizenship, if the i485 question comes up simply indicate the truth whether you did not think it applied to the question at the time or forgot about it at the time whatever is true. 

 

The incident does not affect your citizenship, lying about may, so don't lie.

 

As for your n400 case, to qualify to apply for n400 under the three-year rule, you must have had your green card for 3 years AND be residing together with your US citizen spouse for all three years at your home(s) as well.
