Hi Everyone!

 

My spouse and I are preparing our I-130 application (online filing), and are currently filing in form I130A. We have a few questions to ask to ensure we file correctly and avoid an RFE. Any help is greatly appreciated! 

 

  • Part 1: Address History: For the beneficiary's current address, should we put 'PRESENT' for question 5b. Date To (mm/dd/yyyy)?
  • Part 2: Employment History: As above, for the beneficiary's current employment, should we put 'PRESENT' for question 4b. Date To (mm/dd/yyyy)?
  • Part 2: Employment History: For periods of unemployment, do we need to include an address, or just put 'N/A' in the address section? 
  • Part 3: Information About Your Employment Outside the United States: Should we fill this with the beneficiary's last occupation outside the United States, even though this information is recorded in the previous section? Or should we put 'N/A'?
  • Part 5: Interpreter's Contact Information, Certification, and Signature AND Part 6. Contact Information, Declaration, and Signature of the Person Preparing this Form, if Other Than the Spouse Beneficiary: We are not using an interpreter or a preparer. Should we leave these sections blank, or fill the boxes with 'N/A' throughout?

3.  Frankly, I would not take up any space on the form for periods of unemployment.  

4. If shown above, just enter Above on first line of that section.  Pay attention to the little words like "if"

5. Leave all that blank

 

Note also that you need not and often cannot enter N/A on the forms.  Many sections are rendered inoperable by previous answers.  If something in clearly not applicable based on what is already entered leave it blank.  Note also that some questions are applicable and the answer is "none" or "above".

On the unemployment question, we are thinking to include this as the beneficiary has had several short periods of unemployment in the last few years (less than 2 months each time) and we don't want to cause confusion for the officer reviewing our case by leaving gaps. Under the 'unemployment' title, is an address needed? (we would plan to put the beneficiary's home address).

No, it is not, because there is no employer address when unemployed. I would still just list the employment and not worry about short gaps.

Thanks Pushbrk! That's really useful advice! :) . It is easy for us to worry that we're somehow going to do something wrong which will cause issues!
