The version of the I-129F form that I have is from 11/24/06 and the filing fee is $170.00. Is this the most up to date form?

You have to have it postmarked before July 30 in order to make the $170 fee. It is going up ON July 30 to $455. July 30 is a Monday, so you'll have to have it postmarked by that Friday, July 27. I just spent the last 2 weeks pretty much fulltime working on it so that I could send it to my mom in the US to send it out before the deadline. Whew!

Post offices are also open on Saturdays (usually until noon), so you could also get it postmarked on Saturday the 28th.

and believe it or not there are 24/7 operations in some areas as well. The USPS facility at the MSP airport is an example of one.

That stinks, as I won't be able to file the I-129F until after mid-August. She's coming here on a tourist visa to stay for another week, and she's bringing boarding passes, visa stamps, and photographs as evidence to prove our relationship.

Up until yesterday, I was planning on marrying her while she had the tourist visa... until I did additional research and discovered that that would cause BIG problems. :blink:

1-23-07 NOA1 Notice Date

1-26-07 NOA1 arrives in the post

4-25-07 Touched!

4-26-07 Touched again!

5-3-07 NOA2!!! Two approval emails received at 11:36am

5-10-07 Arrived at NVC/5-14-07 Left NVC - London-bound!

5-17-07??? London receives?

5-20-07 Packet 3 mailed

5-26-07 Packet 3 received

5-29-07 Packet 3 returned, few days later than planned due to bank holiday weekend

6-06-07 Medical in London (called to schedule on May 29)

6-11-07 "Medical in file" at Embassy

6-14-07 Resent packet 3 to Embassy after hearing nothing about first try

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

Nothing should prevent you from marrying her.... As I am sure you are aware the problem is staying and trying to adjust status here after the marriage...

It could cause problems if she married you on the tourist visa and then did not return home.

Did this additional research include a consultation with an experienced immigration attorney?

It doesn't help that she apparently came prepared to apply for adjustment of status, but if you haven't already do consult an attorney to satisfy yourself that you've covered all possibilities.

It seems to me that the K-1 visa is a much more reliable means of getting someone here to marry, compared to marrying her and then trying to find a way to adjust status. Is that a fair statement?

I haven't contacted an attorney on the matter, but I'd read that someone coming over on a tourist visa with the intent to marry is a big no-no. Granted, they'd have to prove that the intent existed, but I think they'd be able to prove it easily enough given the circumstances.

Unless you mean adjust status while she is here in the states, because regardless if you go K-1 or CR1/K3 there is no "finding" a way to adjust status as that procedure is already established.
