IMPORTANT EAD QUESTION !!!!!!!

Timeline

IF ANYONE CAN HELP WITH THIS QUESTION IT SURE WOULD BE GREAT. MY HUBBYS BEEN HERE SINCE NOV. ON A K-3 AND WE ARE JSUT NOW APPLYING FOR AN EAD. WE SENT IT OFF ABOUT 3 WEEKS AGO. IT WAS SIGNED FOR SO WE KNOW THAT IT HAS BEEN RECIEVED BUT, THE CHECK HAS NOT BEEN CASHED. THE ONLY THING THAT I CAN THINKOF IS THAT YOU MIGHT HAVE TO FILE FOR AOS AT THE SAME TIME OR FIRST. WE HAVENT FILED FOR AOS BECAUSE OF TRAVELING ISSUES BUT ARE GOING TO APPLY NEXT MONTH. CAN ANYONE HELP ME OUT WITH THIS ONE???????????................THANKS, SUSAN

01/28/04-met online via yahoo (hot diggity!!!!)

spoke on online and cam every day for over a year

04/01/05-andy comes to tennessee for 2 weeks!!!!! (double hot diggity!!!!)

06/18/05-andy comes back to stay with me for 3 months!!!!!

12/30/05-andy comes back to stay with me for 3 more months!!!!!!!

03/18/06- WE GET MARRIED!!!!!!!!!!!!!!!!!!!!!!!!

***HERE STARTS OUR VISA JOURNEY***

04/03/06-mailed packet to texas

04/07/06-touched

04/08/06-check cashed @ texas

04/16/06- 1st NOA!!!!!!!!!!

05/10/06-mailed packet to chicago

05/12/06-touched

07/20/06-2nd NOA.!!!!!!!!!......took forever !!!!(had to send back additional info which was

some form saying youve never committed any horrible crimes!!!!!!

08/22/06-went for his medical!!!!!!!!!!

****waisted a bunch of time because we both recieved packets and got confused..he was sent

k3/ds papers and i was sent I-864 forms for cr-1....WE GOT MIXED UP!!!!!!!!!

10/03/06-hubby mailed off check list for k3 to embassy

10/12/06-hubby recieved interview date!!!!!!.............NOV 7th @ london embassy!!!!!!!!!!!!!!!OMG

11/07/06-APPROVED!!!!VISA GRANTED!!!! YAY!!!!!!!"

You can apply for a EAD on a K-3 visa without applying for AOS. The EAD will expire when the K-3 does. EADs normally take about 90 days to process, so give it some time. USCIS are also busy right now, so it will probably take some weeks for them to send you a receipt.

Oh and please, don't post in all caps in future, its hard to read! :)

Well at least they did not get the other format codes correct or it would have been an annoying light blue and in bold print looked like:

And yes you can file for EAD before AOS, it is recommended for K-3's to do it this way because K-3's will get an EAD that expires the same time as the I-94 card, If you file for EAD with or after AOS, then the EAD is a 1 year one.
