Hi all,

 

My wife and I have received a message from the NVC in the message centre that says “Please submit every 2020 W-2 form for petitionerName.” and we’re not sure what we need to do next.

 

My wife (the petitioner) was living abroad for the entire 2020 tax year and was not employed by a US based company, and therefore has no W-2 to submit. As part of our initial NVC package we submitted her entire tax transcript for 2020 which was generated by the H&R Block Expat Tax Services which includes a 1040 and 1116 (Foreign Tax Credit) form that clearly shows that all of her income declared in the 1040 was made abroad. 
 

All of our submitted paperwork has been given a status of “Accepted”, including the 2020 Tax Transcript mentioned above, and there are no comments made on the documents directly - we just have that one line message to go off. 
 

Do we just need to submit a letter explaining something to the effect of ‘We have no W-2 because all income was made abroad for the 2020 tax year etc.’? Or should we provide a copy of her overseas tax transcript as evidence of her income? We’re sort of at a loss as to what the NVC is expecting.

Has anyone run into this before or has some advice? 
 

Currently we’re leaning towards providing a letter of explanation for why there are no W-2s rather than trying to provide overseas tax documents.

Yes, do that.  They'll understand.  Alternatively, call then and explain.

We had exactly the same situation, phoned to discuss with NVC and had to just upload a signed statement explaining that the income was foreign earned, so no W2 exists.

 

We had also uploaded pay slips from the UK, so was very disheartening to have a 3 month wait for something that should have been apparent, especially as we had a joint sponsor on the application as well.

Do you have an example of the signed statement you submitted?  I am in the same boat and uploaded my pay slips 6 months ago, added a joint sponsor 3 months ago, and today they wanted the W2 again... I called and she gave me no help.  I'm going to try to speak to a supervisor tomorrow, but at least maybe I could add the signed statement.

We set it out like a normal letter, but the body was:

 

"To whom it may concern,

 

This letter is to acknowledge the request for more evidence, but to inform that my earnings for 2020 were exclusively while working in the United Kingdom, and as such I have no W-2 to submit."

 

Then signed and dated, scanned and uploaded.
