Depends which center your O-1 application goes to. If you are in the north east, it goes to Vermont center and they almost always issue a RFE and are pretty brutal. Isn't the underserved route another waiver though? You are talking about Conrad 30, right? Can you apply for that year round? I know it has a deadline in most states

I see. Oh well, Vermont will be brutal to me then I guess. 
 

apart from Conrad 30 there are waivers that have no limits such as Delta and newly Appalachian waiver. Check it out. They keep rolling physicians and have no deadlines or limits. But expect to be in a remote area.

Hi guys i am new here. Me and my husband both are J1 ECFMG physicians. We applied for hardship on basis of our usa born son in 4/2022. 11/2022 is when dos received i612/i613 from uscis. I know there is a long wait ahead but our J1 visa expires in June 2023. We were thinking one of us can sign a waiver job while the other one can wait for hardship to process? My question is if my husbands signs a job and gets another waiver approved i am sure his hardship application will be cancelled but will it affect mine? 
 

I have a diff case number and everything but we applied together and mentioned each other in our application

Hi! We have the same visa expiration. May I ask how many months did USCIS take in deciding for your case before submitting it to DOS? Am I correct in saying that it took 7 mos.?

Yes it took 7 months

I know it can further take more than a year. What’s your timeline like? Are you a physician too?

 

Waiver job meaning if he signs a Conrod or ARC waiver contract

I am still waiting on USCIS to forward it to DOS. So far almost 7 months and still no update from them. I hope they send it to DOS soon

It shouldn't affect you. Do you have a lawyer? What does he/she say?

Hello. this problem also applies to me. I am a J1 physician too and have submitted hardship waiver very recently. I was planning to apply for an O visa for next year when I find a job, but all of the places that I interview are very interested in getting a HHS waiver with a H1 visa. it''s actually easier than collecting all the letters and everything for O visa, but I don't want that waiver application to effect the hardship waiver. What exactly did your lawyer say?

If your HHS waiver gets approved, your hardship case is thrown out of the window. Essentially. 

So only pull the HHS or other waiver trigger if you think there is no hope in hardship.

Yes he told me that if we sign up for another waiver, it is more likely to be approved before hardship and this application will be nullified then

I understand that part. My husband is going for another waiver option but can it affect my application at dos? As i am planning to wait for it to come.
