  1. What happens if i-485 gets denied? You can reapply if you have a USC spouse. Right? At least you get a status and EAD while waiting for this nightmare waiver.
  2. Lawyer is giving you a good legal advice but only you understand your financial and family situation. With DOS delays, it's hardly possible to retain a non-immigrant status due to their limited expiry periods. That's why we see more people taking risk of applying GC with pending waiver. Some get successful some denied.
  3. As you are married to a USC, even if you apply i-485 and they later deny it due to non presence of waiver at the time of application, you can reapply. It's upon their discretion if they want to approve i-485 after waiver approval but with a pending waiver at the time of filing. It's totally up to you as the worst you will lose is i-485 filing fee, but will avoid job loss on the good side. Seeing your timeline, it might take another 6-8 months to get decision and then you will apply i-485, so you should expect a period without work authorization for sometime in this case

  6. 2022? No way. They have still not finished 2021 cases. Now holiday season is here and work will resume in 2024. "Process it asap" emails are generic and I am getting these replies from the last 1.5 year.
  7. I am surprised to see they decreased it. They should have written 24 months as that's whats going on ground.
  8. By juniors, I mean those whose cases were received after mine already got decisions 6 months ago. So, you applied for hardship on your relative and now you yourself are in hardship. That's story of every other case. The relaxing tactics also work for a few months, not years. I wish all the new cases don't have to go through all this.
  9. Staying hopeful is best to avoid stress/hardship. How long this hope can stay is what is crucial as this is a black box process with no actual path. I was hopeful that they will decide my case by 13th month (as per their published time) but now it's 21st month. Reply is same:" all documents received and case will be processed in coming weeks/months". Many juniors I know have already got decisions.
  10. There is a big flaw in legislation regarding i-612 hardship waivers. Previously they used to decide in 4-6 months and people used to get that while being in status. Now, 90% people get out of status while waiting for this hardship waiver. Unlike i-601, this waiver is much much longer and doesn't provide any status to stay and can't be filed concurrently with i-485. So, now this category brings miseries for everyone who files that. They should either end this category if they don't have resources to process them or decide (even if denial) within their published processing time. Quite unethical what's going on.

  12. Tried multiple senators. All failed to move dos despite best tries. DOS copying pasting same replies from last year.
  13. I was reading DOS email reply to my 20 months old case that says it's first in first out. Of course it's not that how it works.

  16. Even considering the absurd delays in document uploads, electronic transmisttal, your case has already completed its normal processing time.
  17. It can take a week to as long as 10months (I know one case) just to upload the I-612/I-613 on their website. Then it can take 20-24 months or even more to get a decision. Do plan some backup as this process is highly unpredictable.
  18. And then they would have already completed 2 years in home country or keep suffering for two years here in US. Even if DOS post correct timelines on it's website will help many suffering families for deciding a proper strategy.
  19. COVID passed long ago but still pouring its wrath on some (hardship-based) applicants.
