I am a U.S citizen and first I am sponsoring both my parents and then they will sponsor their three daughters later using their green card. Therefore, I am the petitioner and I file my taxes jointly with my husband. In 2018 and 2019, we reported over a 100k on our tax returns. But due to Covid-19 for 2020 tax return, we reported 44k. We put 5  members in our tax return who are myself and my husband, my daughter, and my husband's parents for the year 2018, 2019 and 2020. His dad passed away in Nov 2020. 

Knowing these facts, which I-864 form do I need to  file?

Do I use my husband as a household joint sponsor?

Do I use my husband and myself as sponsor and another person who does not live in our house hold as joint sponsor?

You will fill out I-864 and your husband fills out I-864A, assuming that you want to combine his income with yours (or his exclusively if you do not have any income).  Current Income is the key.  Do you and your husband earn enough currently (monthly income x 12, weekly income x 52, biweekly income x 26, etc.)?  If so, then you should not need a joint sponsor, but should include a several pay stubs (the most recent ones).

 

If you do need a joint sponsor, then that person fills out a separate I-864 and their spouse (if any) fills out I-864A if they need to combine their incomes.
