Hey all,

My wife and I were married yesterday and now we are ready to begin another phase of this long process in AOS. I noticed the fees are going up at the end of the month so I want to apply as soon as I can to avoid pay the $1000+. My question is, my wife does not have an SSN yet and she is planning to apply for one on Monday. And I hear it takes at least 2 weeks to receive the card in the mail. Can she apply for AOS without a SSN? I know on form I-485 it asks for one. Thanks in advance for your help.

You can apply without a SSN. You need the EAD in order to get the social security number anyway and an RFE is better than paying the rate increase anyway.

Not true for K1 if applied for within 76 days of arrival.

Thanks all! I'm planning to send the AOS packet on the 25th of July. If the ssn doesn't come by then, then I will send it w/o it. My wife has an EAD stamp on the back of her I-94 when she came in through JFK. Hopefully, they don give her a hard time in applying for the SSN.

Shes a k-1 so shes entitled to apply for a SSN within the first 76 days as stated above.

What rings said was correct for K-3's, not K-1's.

K-1 visa issued: 12/15/2006

107 days from mailing AOS package to receiving green card! Received 6/27/07 dated 6/20/07

Removing conditions:

mailed 5/22/2009

Recieved at CSC 5/23/2009

Check cashed 5/27/09

NOA date 5/26/09 - still not received

I-551 stamp in passport 6/19/09

Your wife may apply for AOS without the SSN. And since she came on a K-1, she can apply for a SSN without the EAD.

K-3's can't apply for a SSN without the EAD card.

But to inform you, the EAD they are referring to is not merely the EA stamp, it is the EAD card you get when you file for I-765.
