Hi all,

 

I have a quick question in regards to the filing of the i30 for my spouse. I am a natural born citizen of the United States and got married overseas in India a few weeks ago. I am looking to apply for my spouse but I am unsure of what "Legal Name" i put down on the i30 for my wife. On our marriage certificate that we received from the Indian Government, it has her maiden name (so no indication of her new married name). We do plan on changing the name however so I am wondering if we put down her married name or not?

 

Another question this leads to is what passport number do i put on the file? If we do go the route of putting down her married name, this will make it so the name on her passport will be different from the name shown on the i30. If we change her passport, we will have to wait until the passport is in hand to update the passport number?

 

Please any help would be very much appreciated, we are unsure of what to do.

One of the ways to perfect a name change after marriage is to start using the name in post marriage life including immigration applications or petitions, government issued ID, etc.

So the marriage certificate even if it doesn't include the married name counts towards a name change? Just wanting to make sure that if i put down the married name it doesn't cause any issues. Also what should I do in regards to the passport (which is currently in her maiden name) ?

Get a  new passport because the visa gets issued in the passport name regardless of what you want

right but on the i30 filing, should i put down the new passport number or the old one ? (we don't have the new one yet, but we're in the process of getting it) It may take a bit while for the new passport to come in which is why I'm asking

Doesn't matter.  I don't think its even required unless the alien is currently in the USA. 

 

 You will put the correct one on the ds260 application in the future
