My fiancé and I sent Form I-129F three weeks ago to begin the K1 visa process (received two weeks ago). I’m the American and my fiancé is a foreigner. We currently live outside of the US.

Unfortunately, the credit card we used for the application was closed for fraud before it was able to be processed by the USCIS. So of course our application will be rejected. My question is, is it possible/a good idea to send another application as soon as possible, or do I have to wait for the package to come back to us before we re-file? Obviously we would not like to waste any more time if possible, especially given that there are already a lot of delays. I’ve tried to call USCIS (as our specific concern doesn’t seem to be addressed on the website), and it was extremely difficult to get to a real person, and when I finally did, they couldn’t really give us any details about how to proceed.

Another question. We included the notification form G-1145 in the package, do they still notify people if their application is rejected? We don't have any updates.

Thank you for the help!

It will be returned and no you don't get electronic notification of a rejection.  You can resubmit,  you don't have to wait

YMMV

Thanks for the reply. I was thinking it should be fine to resubmit, but I saw online somewhere that someone who was rejected due to insufficient funds was required to send an extra payment with their resubmission. Do you know if that isn’t the case then?

If you paid by check and if the check was returned,  they will assess a NSF fee.  Not your situation.

YMMV
