Hello, I have a few questions that I need clarification for. Our petition was approved recently and we have to fill out the AOS

1) What will be considered the most recent tax year? 2019 or 2020 (considering 2021 just started and we are filling now)

2) The 2017 tax return was filed in joint with the ex. Will it be an issue to submit that?

3) Should we wait for the tax transcript for the year 2020 or should we go ahead and file using the transcripts from 2017(filed jointly with ex), 2018 and 2019?

1.  The most recent tax year is not a valid term in this context.  The most recently filed tax return goes on the top line of three.  Today, I would file the 2020 return ASAP and use that as the latest data point on that section of the form.

 

2.  Not an issue but no need to submit it.  You can simply enter the total income figure from it.

 

3.  No need to wait for the transcript.  Just file the return and send in a complete copy including all schedules, W2 forms etc. along with a current pay stub.

 

Your "current income" does not come from a tax return.  It comes from your pay stub.  Gross pay for a full pay period times the number of pay periods in a year.  Note that twice a month is 24 pay periods, but every two weeks is 26.
