I had a lawyer draw up my paperwork in bangkok, have my fiance come into his office and sign them, then he fedex'd them to me here in America.

I just got them today...and there is ONE mistake;

my city I live in is "Marietta", but it was typed in "Marrietta" on all the forms. The zip code is still put in properly. Is this going to cause me to get an RFE or a denial? Will they ask me to redo all this?

Also, it has my signature date as 20JUN2007. However, my divorce wont be finalized until 17JUL2007. I'm not sending the paperwork until I get my divorce decree, but with the American Immigration service see that I signed the papers prior to my divorce and then deny me?

Thanks a lot for your help...I'm freaking out and stresssing about this since I just got the paperwork today....hopefully you guys will tell me its no big deal

The only form your form your foriegn fiance has to sign is the G325A (fiance sig also needed on the letter of intent, which is not a form). You can download the fillable PDFs for your own G325A and the 129F and refill them with the correct city and dates if you want. Why would you have an attorney in Bangkok prepare your forms? Do they have a US office you can contact about fixing the errors?

I, like you, hired an attorney in BKK that has offices in both the USA and Thailand. I know for sure that the forms that you fill out cannot be predated prior to your divorce. Reason, the forms ask if you are free to marry and if your divorce isn't final then you arent free to marry. Your paperwork will have to be dated after July 17th, 2007. Just for some people here who don't know or understand everyone's situation, I hired an attorney in Bangkok because my fiance is still learning English and would have difficulty filling out our forms. She would also have a problem with the translation service, police checks, doctor's appointments, etc. You can send me a PM and let me know what attorney you hired and I can share stories with you. I have gone through the whole process in 5 1/2 months using the attorney who filed early and got all the other documents and appointments done quicky. He is also going to the embassy with us for our interview on July 9th. Hiring an attorney is a personal choice. I did it to make the whole process easy on my fiance and to reduce stress. Let me know if you have any questions. Ken

You can just re-do the forms correctly or line through the misspelled city and write it correctly above.

If you file before your divorce is final, you won't be able to include the divorce decree. Just wait until you have it and get the right dates on the forms. Don't have the immigrant's signature date precede the final date of your divorce either. Filing before the divorce is final will get you a sure denial of the petition. Your fiancee signing the forms before the divorce is final is likely to cause problems at the time of interview. Even you meeting and becoming engaged while you were still married can raise the fraud issue, so be prepared.
