Hey there everyone!

Any suggestions or words of advice for peace of mind will be appreciated. We received a request for evidence for our I-485 (AOS), and we sent everything in. On the request for evidence these words are written:

"You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(B)(10)(ii) until ninety (90) days after the missing evidence is received."

What does this mean? I triied looking up the Title 8 section of the law mentioned, but I couldn't find that section! Does this mean we have to wait 3 months before they will even consider the EAD application? They have received our evidence and the I-485(AOS) was updated and touched but the EAD has not been touched.

I have been considering writing a letter to ask them to update our EAD, but I don't know if it will help.

Any ideas?

August 10, 2006: Fed-ex package received by Vermont

August 14, 2006: Vermont acknowledges beginning process

August 20, 2006: NOA-1 received at home address in NY

August 24, 2006: Touched (likely because step-mother was meddling with process)

April 23rd, 2007: UPS package delivered to Chicago

April 27th, 2007: Date of NOA for AOS and EAD

April 30th, 2007: INS deposits checks

May 2, 2007: Touched

May 9, 2007: RFE sent to us by immigration

May 16th, 2007: Biometrics

June 1, 2007: Evidence sent to immigration

June 16th: Touched

June ??th: Case transferred to California office

July 5th, 2007: EAD approved and card ordered by immigration, should come within 30 days

July 5th, 2007: AOS touched

As long as you sent them everything they requested in the RFE letter, you have nothing to worry about. After I sent in my RFE, they updated my I-485 and I-130, but the EAD wasn't touched until it was close to approval and I received the card production ordered email. Despite the RFE, my EAD was still approved in 80 days. So, just be patient, and wait for 90 days from NOA1 to pass before you start worrying. Good luck.

12/12/06.... Biometrics done (Day 29)

01/20/07...Interview notice received dated Jan. 12, Yay!! (Day 68)

01/30/07....EAD touched, finally!(Day 78)

02/01/07....I-485, I-130 touched. EAD card production ordered (Day 80)

02/07/07....EAD card received in mail (Day 86)

02/26/07...Interview - name check pending (Day 105)

06/21/07.... Card production ordered email...omigosh! (Day 220)

06/24/07.....Email: Notice mailed welcoming new permanent resident on 6/22

06/30/07.....Welcome notice received in snail mail

07/02/07....Email: Approval notice sent. GC received in mail!!! (232 days from filing)

We also had the same message with our AOS RFE, but all ended well.

Aug 31st Congratulations letter, no interview needed
Sept 21st 2009. New green card with conditions removed arrived.

N400 Status
07/26/10 N400 mailed via UPS. Three year rule
08/03/10. Check cashed.
08/06/10 NOA letter received, but "Request for evidence" showing on the status website.
08/08/10 NOA #2. Biometrics appointment letter. Scheduled for 08/31/10
08/09/10 Biometrics completed. Walk in.
11/01/10 Touched. Transferred to local (Tampa) office
12/06/10 Interview . Passed
01/11/11 Oath ceremony
