Good Day 

 

I am unsure of how to answer this question on DS 5540...

 

PART 4: List below all US federal tax returns you have filed within the last 3 years and attach your IRS transcript:

 

I am the beneficiary who live outside the US, my husband in the US files married filing seperately as my income is not stated on his tax return....for the above question do I attach his tax returns? The same ones I uploaded to the CEAC website?

If you have never filed US tax returns, and have not been required to do so, then this is not applicable to you as Beneficiary. DS5540 is requesting tax returns for which YOU are a relevant party. The I-864 supporting tax returns are your husband’s, not yours (since he filed married but separate).

My husband (petitioner) also filed married filing separately in US. Our lawyer included his last 3 year's tax return on my DS5540.
