Goodmorning everyone,

 

I received a request for initial evidence few days ago after submitting my application. I am on F1 visa but adjusting status through marriage. My Wife isn’t working at the moment so we had to use a joint sponsor, we only sent I-864 for the joint sponsor but USCIS needs my wife to send form I-864 as well.

 

Here is my question:

 

We gave birth to our Son after we had sent out the initial application so on our previous household size in form  I-944 and the rest I had household size as myself and my wife only. Can my Wife go ahead to include him as an addition to our household size while filling form I-864? Or we shouldn’t since he wasn’t included in our most recent tax filing as a dependent?

Your household has changed and your son needs to be added when you submit her I864 - how you filed taxes last year doesn’t matter - he is here now and there needs to be enough income to cover him as well.

I have two more questions then I am good to go.

 

on my joint sponsors form I-864

 

1. Under Part 6, Item 7 (Sponsor Employment and Income)- My current individual annual income, he wrote $60,000, this figure is different from what was on his annual income from his most recent tax return, should he correct it or leave it?

 

2. Under Part 6, item 20 (My current annual household), he wrote $60,000 again. He filed the most recent tax return with his Wife and line 8b on their form 1040 states $69,690. Is the $60,000 he wrote down the correct figure?

 

3. Lastly, Part 6, item 24a (Most recent tax year/total income). 2019 he wrote $69,778 which is the total income on his form 1040. He filed for self employment as well has his college job as such there is also a Schedule C Form 1040 this brings his adjusted gross income on form 1040 to $69,690. My question is this, shouldn’t it be $69,690 that should have been written in 24a?

I think it should have been $69,690 as well. Does he expect to make less this year? That could be the only reason I would think he wrote 60k.

I believe he indicated $60000 because that his what he expects to make this year, he backed it up with a letter from his work place. Should he go ahead with the 60k under Part 6 item 7? And also Under Part 6, item 20 and 24a Should he go ahead to put $69,690? N.B he jointly filed 2019 tax refund with his wife and the adjusted gross comes to $69,690
