F2A got DQed today.

Submitted all docs to NVC in late April.

Any chance the visa ban will be removed before year end?

I heard lawsuits filed against Trump's executive order on H1B, H4, but not for Spouse of PR.

Any chance it will be removed before 2021? Yes.

How likely? Depends who you ask I guess. Personally, I see little chance for success...INA 212(f) gives broad power to the POTUS to deny a class of aliens, so long as it is not done in a way that violates other laws (like a ban based on gender, sex, race, nationality, etc.).

IR-5 visas I think stand a better chance...both because they are IRs, as well as the stated reason for the EO is due to employment concerns, and IR-5 is one of the least likely categories banned to impact the employment market.

 

The previous lawsuits I saw (I was on a call for one of them) failed to even get consideration due to a lack of standing. Routine visa processing is suspended worldwide and is only starting to resume mission critical visas in some areas...even if F2A was not explicitly banned, they wouldn't be interviewed or issued right now (except in emergency cases, in whcih case they likely already would qualify for an exemption of the ban IMHO). Either way, nobody that I am aware of in the F2A category has actually been refused a visa due to the ban. As such, there is nobody with standing to make a case. Effectively, the ban on F2A is a ban in the books but hasn't actually been applied anywhere yet.
