Hey, so today we received a request for initial evidence, they said that the sponsor must submit a complete federal income tax return for the most recent tax year. So my husband is the sponsor as well as his mother who is the household sponsor as he doesn’t make enough on his own. We submitted both his and his mother’s W2s for 2019 as well as some pay stubs but I assume this was not enough. 
 

my husband has now gone onto his tax company’s site and it gives him the option to get an “individual tax declaration for electronic filing”  Is this what is needed? His mother can get the same if this is it. Is there anything else we need to do? I assume because it says only for the most recent year, we will only need 2019’s and not the previous years?  My husband has just been laid off from his job which obviously doesn’t affect the tax returns but will be an issue if we need anything else such as pay stubs etc? 
 

I’m really worried and want to make sure we have done everything correctly to avoid being rejected. Thanks everyone for your help.

A Tax Return is a mandatory document to send. You have the option to send the 1040 + W2 + 1099 + schedules, or send a tax return transcript that you can get from the IRS website.

 

If they didn't file a return for the latest year, you need to write a letter explaining why they didn't file.

 

If you didn't send a return for either the sponsor or joint sponsor, you should send for both.

Thank you so much! So he went online and he’s got the 1029, 1040 and 8880 and we already sent in the W2’s to them last time. He doesn’t have any 1099. Will this still be okay?

Is he able to get Tax Return Transcript from the IRS website? I would send that if he can download it from there. If he can't, then send 1040 and W2.
