I-864 or I-864A?

Hi guys,

 

My wife is the petitioner and does not have a job, thus will not provide financial support. I understand she has to fill-in I-864 along with a tax return - no problem.

 

My mother-in-law is going to provide all of the financial support. I've read lots on here that people said the supporting family member fills-in I-864, but was wondering if it was outdated. I ask because NVC says:

 

If the petitioner cannot meet the income requirements outlined in the I-864P, Poverty Guidelines, the petitioner can use the income of other household members to meet these requirements. The household member(s) must submit Form I-864A, Contract Between Sponsor and Household Member. Similarly, if a joint sponsor uses the income of his or her household members to meet these financial requirements, the household member(s) must also submit Form I-864A, Contract Between Sponsor and Household Member.
 

Does anyone have any recent experience of this?

I-864a is for combining income. Your spouse has no income to combine with anybody, so her mother, your joint sponsor, completes an I-864.  If she's married filing a joint tax return, her husband provides an I-864a, whether he has income or not.
