Hi Everyone,

 

Due to COVID-19 extensions in Indiana, I likely will not get a certified marriage license / certificate for at least two more weeks. We got married for K1 within the 90 day window, but it's now (as in April 30th) after the 90 calendar days. The Clerk's office is closed until May 15th and while they are still issuing certificates, it's backlogged for any personnel action. 

 

So my first question is, for the ###, is a certified copy of the marriage license required, or is a copy of the original marriage license Indiana sent me that we filled out with the marriage details and officiant's signature good enough?

 

Second question, is it okay to mail the AOS packet potentially a couple weeks after the 90 day K1 period is up? My hold up is the certified copy of the marriage license. 

 

Any advice or guidance is greatly appreciated! Thank you!

You need a marriage certificate. So you can't use it unless your license is the type that becomes a certificate when the judge signs it. 

 

Every document sent to USCIS can be a photocopy.

 

There's usually no issue on delaying filing for AOS. If you got married within the 90 days, you're good. Just don't take too long
