CR1/IR1 visa validity and interview scheduling flexibility

Hi All

 

For those that recently received cr1/ir1 visa in Mumbai consulate can you please let me know what was the validity date given on the visa. Is it 6 weeks or closer to 6 months?

 

Also do we have the option to postpone interview if wife can’t attend the interview on the date they gave due to medical conditions? My wife is expecting our baby and if the interview gets scheduled after baby is born then can we add baby to our petition? I tried calling consulate support phone number but the representatives couldn’t answer this and didn’t know the process. But the Mumbai consulate website says if baby is born during NVC or before interview then we can inform NVC or consulate to add baby to petition. Hoping someone may have gone through similar here.

Q.6 Can the children of an immigrant visa applicant be included in a single petition?

Children of U.S. citizens are considered Immediate Relatives (IR) and must have individual petitions filed for them. Petitions for immediate relatives may be filed simultaneously at U.S. Citizenship and Immigration Services. Children of applicants with family-based petitions (F category) may derive immigration benefits from the same petition provided that they are single and under 21. Such children are called derivatives for purposes of immigration. Only biological or legally-adopted children are entitled to derivative status. A non-orphan adopted child must have been legally adopted before the age of 16 and must have been in the physical and legal custody of the adoptive parent for at least two years. A child born after a petition was filed and approved may be registered or added on to the petition as a derivative. The principal applicant should submit photocopies of the child's birth certificate and child’s passport to the NVC or the U.S. Embassy or Mumbai Consulate and pay the corresponding visa processing fee.

For a CR1/IR1 the answer is no, you can not add them to the petitions as derivatives are not allowed.  If you can pass citizenship thru CRBA then you do CRBA and get a passport.  If not then you have to file an I-130 for the child.

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thanks for clarification and I’ll go through the CRBA route to pass citizenship to my child. However, do we still need to update our application/petition to mention our child’s name. Because when we file NVC child is not born yet born so application just has mine and my wife’s name. So how do we update it after child is born to also mention child’s name in it.

If you have done the DS-260 then it can be updated at interview.

The I-130 would also be noted at the interview.

So here is the issue to be aware of.   If the child isn't born when you file the I-864 but born before the interview you should bring an updated I-864 to the interview.  Obviously your household size will increase by 1.
