Quick question guys...is it necessary to send the original I-797C approval notice with the AOS documents or is a copy ok? Also is it correct that all docs are sent in 1 package to Chicago...travel, work and AOS?

We had a crappy experience trying to get Yenifer's learners permit...with 29 days left on her visa (I94) they said it takes 30 days for the Gov't to process the permit so by the time she got it it would be invalid, but with an AOS NOA she could do it because it would show that she plans to stay...DUH>>>WE'RE MARRIED...WHERE DO YOU THINK SHE'S GOING??? I was pissed but I'm ok now that I've had a chance to swallow the lump. :lol:

We are trying now to get through this next step (AOS)...

As you probably know, I'm hardly the expert in AOS. :blink: But, I would avoid sending any original documents unless specifically instructed to do so. In your case, I'm sure that a copy of the 797 is adequate since they almost certainly have the same info on file.

Hang in there, buddy. I'm sure you'll have a much smoother time than we've had simply because you chose a better road.

I think it's worth it if your spouse plans to travel within the first year of her/his arrival. AOS can take between 6-12 months, some times longer, to be approved and if anything happens and they have to travel outside of the US, it's good to have the AP ready. Plus, you won't have to pay extra for it since it's all included in the $1,010 you send with the I-485.

We just put in a bogus date about 3 months out just in case they want to see travel plans...it can't hurt.

Hopefully we will send our package on Monday...I will keep you posted

So we put up a generic 2 weeks and a generic date of trip. In your case this will not mean much as in ours.

I wrote up a document describing la abuela's frail health and the need to be able to travel on short notice pending any worsening of her health. God forbid it would be needed, and it was. Try to find an honest reason to have AP.

On the instructions said that I must attach a copy of any document issued by USCIS showing my present status. Which document that will be?

A copy of the I-94 and the Visa in status as well as a letter stating that the AP is for readmission while the AOS is pending.

How long does it normally take for USCIS to cash the check and send out a NOA? I sent the package on FEB 19. I'm just nervous that the package will not arrive there for some reason.

Hopefully the NOA1 acknowledging receipt of the AOS pack should be upon you any day now... as for the checks to clear your bank is a question of staggering proportions. Hope you get both soon even though one will impoverish you for sure...

Hi Matt,

We sent our AOS on Feb 01, the check was cashed on the 11(Monday) but the funny thing is that the NOA1 is dated 02-08 (Friday), we got the letter on the 14, and the receipt for the money a day later, the 15. My husband had his biometrics this past Wednesday the 27.

I hope this can help you, my husband has a K-3 as well.

I spoke to soon. My wife received the 2x NOAs today, but when I search for them on the USCIS site it says that it can not find the cases. Has anyone else experienced this problem?

Oh that's pretty common actually. Check the case numbers again or call "Customer Service" with your MSC numbers if those are the ones you got.

We're still somewhere in the post-CSC transfer limbo. I'm hoping to be hearing from them soon so we can get the 2 year card ASAP.

Hi all, I am nearly ready to send my AOS package's, and have a couple of questions regarding the (I-864 Affidavit of Support)

1) If I read the "checl list" with this form correctly, it appears only one year tax return needs to be submitted? The second and third years as well as pay stubs only if you do not meet the poverty guidelines?

2) If sponsoring more than one person (in my case mother and child), supporting documents only need to be submitted for the intending immigrant? As well a photo copy of this form is acceptable with the childs I-485?

3) Lastly I am slightly confused by line item 24-e, the sample form here in VJ shows the intending immigrant's name listed here? Sandy has an accompanying dependent, so do we also need to file I-864A, or only if her income (none) to to help support the dependent child? I plan to not check this box, unless someone sugest that I need to.

Hopefully someone here has been through and completed this document (I-864) for multiple people!
