Timeline

Here is my dilemma. Last year I quit my job and went to Vietnam at the beginning of the year (left January 10, 2006) to get married. I came back in February, but then I went with my mother to China to take a look at some property that we owned that was red tagged to be taken over by the governent to be rebuilt. Then I came back in April and in June I had to go back to Vietnam because there was a mixup in paperwork and I had to go back and sign our marriage license at the Justice Department. When I came back in late June, I struggled to find a decent job and in September, I finally found a good full time job, but needless to say I didn't meet the poverty income requirement for last year.

This year however, I will be easily over the income requirement with no problem. I even got a signed letter from my boss stating my title and full time/permanent status along with my paycheck stubs for this entire year. My question is, would it be possible that she will a problem because of last year's below required income? Is there anything else I can do to show them that I am qualified to support her based on my income for this year?

12/05/2007 Interview Date: failed

Timeline

The consular officer look at current income most, so the letter from employer, and pay stubs show that you should be above the 125% line for this year and years to follow.

If you still feel abit unsure about it, consider a co-sponsor at least for the K-3 visa, and then be the solo sponsor when you file to adjust status in the USA.

Do not rely on co-sponsors for the HCM consulate. If you can, try, try, try your best to give as much supporting evidence relating toward your new, current job and salary. Though, typically, the consulate mostly cares about your income from the previous year. I do hear that they are more likely to accept a co-sponsor for a k-3 than over a k-1, so you may be in the clear....good luck.

Do bank savings that total more then the income requirement for a year do good also ?

Large amounts of savings are definitely good proof of evidence also. If you don't have the necassary tax transcripts you will need everything you can get, so you would want to show your bank records. They want a letter from your bank that shows beginning average and ending balances anyway.

The answer is too provide the last 3 years of tax records and w-2's along with an affidavit stating why your income was low last year and current paycheck stubs showing your above the income requirments and letter from your job and money in savings, stocks, etc. Bank statments! Always can get a family member to co-sponsor. A lawyer is good to help write up the affidavit of support.
