CSPA - still relevant?

Hello,

 

My mom, LPR, applied for me to become LPR, I'm outside of US and I have a priority date of March 21 2018. I got the I-130 approved on Sept 10th 2019. The documents were sent to NVC, electronically - as per the rules for my country, on Nov 22nd 2019. I'm not 21 yo yet, but I will be soon, Apt 12th 2020. NVC already sent the case back with "Invalid Doc" on Jan 10th, the issue was fixed and the documents were sent the same day. I still didn't hear back from NVC, based on what I read the case is put back at the end of the queue 🤔 . 

 

I was not aware of CSPA - which at this point I think it's my only hope - is this still applicable? My status is still single and I don't plan to get married before this get's clarified.

 

Looking forward to feedback and your opinion.

You should be fine, you have nearly 18 months protection under CSPA and you aren’t even 21 yet. (Also, you shouldn’t be at the back of the queue.  Did you follow up with nvc to check documents received?)

CSPA is calculated automatically by the CO, but you can also ask to ensure.

actually - did you already submit a DS260? If so you are covered anyway as will have fulfilled the CSPA requirement to “seek to acquire” a visa within a year of your visa number becoming available.
