Hello,

 

I'm a Canadian living in the Boston area on TN status planning to marry a US citizen on May 17, 2020. (Our wedding will, however, be in New York.) I'm looking to hire a lawyer to assist with the process. My questions are:

  • Am I correct to be cautious and hire a lawyer due to possible issues surrounding dual intent with a TN visa?
  • I am looking for lawyers who specialize in TN status as my experience is that many lawyers are unfamiliar with TN. However, the specialists I'm finding are in New York. How important is it for the lawyer to be in state? How important is it for the lawyer to specialize in TN?
  • What is a typical fee for this process?

Provided you don't plan to leave the USA and reenter with intent to immigrate you should be fine to AOS without a lawyer.   Just keep your happy butt where it is and send the paperwork after the wedding. 

Intent is decided at entry. After that they can't deny for intent.

I was a TN and filed my own AOS.  I just followed the guide here on this site.  The main thing you need to make sure is that when you file your AOS you have enough time still remaining on your TN, probably at least 1 year. Since TN is not dual intent, if you file your AOS too late and your TN expires before you get your EAD you won't be able to work, and you won't be able to get a new TN since you have already have shown intent to immigrate.
