Help with I-864 Affidavit of Support...?

Hi,

 

I'm currently in the process of filling out the Affidavit of Support for my step-child but I have some questions:

 

1.) My husband became a Permanent Resident two years ago. I filed out the affidavit of support for him too back then. Am I able to add him as a co-sponsor? Do I need to? I make around $33,000 a year on average.(I think poverty level for 2019 is $26,000, or $32,000 if I have to bump my household size up to 4 and include my niece). My husband works full time and makes a lot more money and the tax forms I'm submitting have both of our incomes on them since we file jointly. If I can/should add him as a co-sponsor do I just fill out a separate form for him?

 

2.) My niece has been living with us for the past 3 1/2 years while her mom got herself some help so my husband and I have been supporting her and claiming her on our tax returns. In April of this year she was finally able to move back in with her mother full time. We won't be claiming her as a dependent on our 2019 taxes since her mom will be doing so. Do I still include her as part of our household? So my household number would be 4 instead of 3?

1.  You as the petitioner/sponsor files an I-864.  Your husband needs to file an I-864a as your Household Member.

 

2.  Your niece is counted on the I-864 since she was claimed as a dependent on your latest tax return.  Does not matter that she moved out.  Does not matter that you will not claim her on a future return.  Your household size is 4.
