Hi, my wife is my primary sponsor but is currently a student and only works part time with a very low salary. We are using my sister in law who earns 3x the poverty line as a joint sponsor.

Question, for my wifes i864 , how do we answer question 23a asking if shes filed tax return for each of the 3 most recent tax years?  In 2016 she didnt work, but did the following two years- part time and full time for some of it-  for which we have the tax return transcripts.

Should we just check the box for no, then check the box for 25, and provide proof of study?

Thanks

based on the instruction you put for 24c: 2016 and 0 under total income. and attach the transcript for the most recent year (2018 only). Attach evidence if she was not required to file taxes for 2016 and check the box 25.

NOTE: Do not leave the boxes for Item Number 24.a. blank. Type or print the most recent tax year and your total income for that most recent tax year. If the amount was zero, type or print “zero” or if you were not required to file a Federal income tax return type or print “N/A” for not applicable.

her income is so low for the last 2 years, I'm wondering if you entered her return amount instead of her total income?

She was a student for 2016 to 2018, worked part time some of 2017 and 2018.  Thats why the income was so low. Shes a student now with a very low income, thats why we are using a joint sponsor.
