Timeline

I am a little confused about this waiver process. I know that the person (not the USC) files in the embassy. then what? does the embassy send the waiver back to the uscis? and it takes like a year? how are some counrtries faster than others if they are all sent back to the uscis? this question might have been asked, but ive been looking everywhere for it and i cannot find it.

Kaitlyn, if a waiver is necessary due to a visa ineligiblity, it's submitted by the beneficiary at the consulate where the interview takes place. First the interviewer has to determine that the beneficiary is eligible to file a waiver. Then, the waiver fee is paid, fingerprints are taken (and paid for) and the hardship letter and evidence from the USC is submitted. Some consulates do not process waivers and therefore they forward to another overseas location. But they are not sent back to the US - they are processed in the district where the beneficiary lives. (Partly, this is because the basis of the hardship letter that accompanies the waiver is why the USC cannot live in the US without the beneificary, and also why the USC cannot relocate permanently to the country of the beneficiary).
