Hello all, 

 

I married my wife back in February 2019 and we are in the middle of the visa process. My wife has been working in the USA on a B1. She is a domestic servant of an American diplomat and came with them from England. I have read documentation on the irs.gov and I believe that she needs to file taxes for the 3 years she has been in the USA.  She is no longer working for her employer and did not receive any W-2s.  I also checked her wage and income transcript and it doesn't look like they paid any taxes, as they were supposed to as required in contract.  What should I do?  I am worried that we won't have time to file the past 3 years and get them back before the interview. I don't have an interview date set yet but I expect it in the next couple of months.

Apr. 20, 2019- I-130, I-485, I-765 Filed

May 1, 2019- Checks Cashed, Texts received

May 4, 2019- NOA received

May 10, 2019- Biometrics Appointment Letter Received

May 22, 2019- Biometrics Appointment in Baltimore, MD

September 4, 2019- Received courtesy letter about I-693

September 5, 2019- I485 status changed to "Case is Ready to Be Scheduled for An Interview"

September 9, 2019- Medical exam done

October 10, 2019 - Form I-131, Application for Travel Document, approved

October 10, 2019 - EAD approved

October 18, 2019 - Combo card in hand

February 24, 2019- Interview

She has to settle up with the taxman (IRS) first.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)
