My fiancé and I are currently in the process of a K1 Visa.  We have a NOA2 and awaiting a NVC receive date.  She is currently 2 months pregnant.  She also has three children whom we agreed I would petition for IR1 to come after we got married.  How does this new policy affect us?

Whoa!  First why wouldn't you use follow to join for the children within a year?  Doing a CR2/IR2 will take another year plus.

 

The new policy, as mostly being discussed here, would require the I-944 to be filed with the I-864 at AOS.  That assumes it does not get changed or challenged.

Is it too late to add the kids to the petition to follow to join within a year at this point?

I think if they are listed in the petition as her children you can add the K2s at the VISA DS-160 stage.
