No longer have passport with Visa

Hello all!

 

I came to the US from Canada a few years ago on a K1 visa, got married, etc etc. I kind of put off filing for AOS and am now starting the process. (Yep, I know I should have done it sooner but we had a bunch of stuff going on, then had a baby, and all that jazz) 

 

However, in the midst of all of this my Canadian passport was damaged and had to be replaced. They did not - despite me asking them with the check mark on my passport application and a letter I wrote to go along with said application - send the old passport with my Visa and entry stamp in it. I’ve got a photocopy of my visa page I believe in my package with all my immigration stuff from 3 years ago, however I don’t have the page stamped with my entry stamp or physical copy of my Visa now. It’s been destroyed. 

 

Is this going to cause an issue? Can I just submit a copy of my (obviously now expired) I-94 and call it done? It’ll show my entry, and I’ve got a photocopy of my Visa anyway. Will I run into any issues with my application or medical appointment?

Your photo copies of visa/i94 (or downloaded from web as suggested) should be good. At worst you can FOIA this stuff from DHS if it comes down to it (doubtful it would). I believe you would have to do another medical though as they expire after 1 year.
