Removing conditions interview

Hey guys, I filed today. I was just curious, are the uscis interviewing everybody for i751 now? 

 

I know previously the interview was a more rare occurance. We were interviewed for i130+ i485 a couple years ago.

If you’ve already been interviewed in the United States and you have strong evidence in your ROC packet then the interview would likely be waived. This is the official guideline: 

 

  • They can make a decision based on the record because it contains sufficient evidence about the bona fides of the marriage and that the marriage was not entered into in order to evade U.S. immigration laws;
  • For Form I-751 cases received on or after December 10, 2018, USCIS has previously interviewed the principal petitioner;
  • There is no indication of fraud or misrepresentation in the Form I-751 or the supporting documentation; and
  • There are no complex facts or issues that require an interview to resolve.

 

That said, a lot of people are still getting approved without an interview despite never having gotten interviewed in the US before, so it is more important that your evidence is strong enough to demonstrate Bona Fide marriage life.
