Changing wife’s surname while AOS is pending ?

My wife came here on K-1 visa and she just received her EAD/AP combo card and her SS card . We are waiting for the green card interview to be scheduled .

We both want her to have my surname but all her current documents from USCIS and her SS card are in her current family surname .

Should we wait until after she gets her green card to start the process of legally changing her surname to mine ?

We would prefer for her green card and SS card to have my surname .

Any thoughts and advice is greatly appreciated!

The marriage certificate would have been an enough document for a name change. If you wanted the EAD/AP and GC to be under your surname you should have used it on the application forms. I guess you can try to request the name change during the interview but I have no idea how likely the IO will grant it. Best of luck!

Yes, I should have done this during the application forms, I didn’t realize it was possible to do this during the application forms . 

I hope they will allow us to change it after the interview .

So basically we have to wait until after the interview to do anything !

Yup, try to change it at the interview (not after!). You can also try to make an InfoPass appointment if available in your field office) to try to update the name beforehand. No harm in trying.

 

If the green card is issued in the maiden name, you would have to file an I-90 if you want to change it (including paying the fee to do so).
