Hello, I was wondering if anyone had experience or advice on the following:

My Australian (of Greek parents) boyfriend finally obtained his legal Greek residency after 4 years of living in Greece. During that time until now, I believe he would have been classified as an illegal alien, though he does have proof that he attempted to get started on his paperwork 2 months after arriving here. The police didn't seem concerned in the slightest with his status..

During the past 4 years he has also been working for family members' businesses "under the radar" and not paid taxes, though the wages have been low anyway.

What's the best way to go about filling out the location and employment history forms for his past 5 years? Should he honestly list having been in Greece for 4 years even if it wasn't legal until recently? Should he list employers if he didn't pay tax?--I mean, will they contact previous employers and can they get in trouble for employing people off the books? Also, will it come back to bite us in the butt when they look at his employment history but he says he has no tax forms for the past 4 years?

I'm so confused!

Finally, when I met Kosta I was traveling, and then opted to stay in Greece with him. Just these past few months I have overstayed my visa here, but it shouldn't be a problem for me leaving as I can go through Italy or another Schengen country. They have no proof I entered Greece because we flew in from Germany in December, and that's the last stamp on my passport. But, should I list that I've been living in Greece for the past year? Or list that I've been living in Maryland, and describe it as a "trip"?

We just recently set up a joint bank account here in Greece with both our names on it.. will the processors question that if I consider this to have just been a "trip" yet I have an established bank account here?

Any advice??

Always tell the truth on immigration forms and to immigration officials. Lying can get your fiance banned from the US for 10 years. Eventually, your fiance will need a "no crime" certificate from every country he's lived in since age 16. I have no idea how Greece will deal with his unlawful presence from the past. It's best to check that out with the local authorities.

Facts are cheap...knowing how to use them is precious...

he can always say he was doing odd jobs as a freelancer (thats exactly what he was doing...right) and not to lie about anything that can be proved. If he was an illegal resident then he might not get a police clearance from there as he has no resident permit.

Remember the golden rule of the thumb...never lie....but a foolish act that can not be proved need not be exposed. like the greece bank acount for example.

And what can be proved need to be said....the american consular officers are also human and they understand...there always keep allowances for people who are honest. They might consider since his parents were greek and that he had applied for greek residency. But if they catch your fiancee lying, they will interrogate him and he will have to tell another lie to cover up the first and you both have had it. hope this is explanatory enough.

Have a consultation with a US immigration attorney experienced in family immigration to discuss these circumstances and advise you accordingly. Some of these issues may be important, some may not, to US immigration officials.
