We filed or joint petition of I-751 last april sent to California Service Center, we made it trough a lawyer (we wanted to do everything right) and some days after that I had to travel because my father got very sick in my country (mexico) a month after that I still here in my country waiting for my dad to get better...I haven't heard anything from them they haven't cleared the check or sent me any receipt notice (somebody checks my mail everyday) Is it possible that our lawyer is procrastinating and haven't sent the package? or does it takes that long I'm very worried because I'm out of the country and my green card expires next June 27....

Another question we have a daughter is it true that having kids in common makes it easier??

By the way my husband just came back from Iraq and is at a military school in Germany....

Hi!

Have you asked to your lawyer if he/she sent the package?, lawyers normally know better and send the paperwork with a delivery confirmation, you may ask your lawyer if he has the proof of delivery with him.

When I did the AOS I did it with a lawyer, I was not familiar with forums, and yes in my case, my lawyer was procastinating.

I don't know if anyone can say that it's true or not, but I would think so and it's what I'm banking on in my petition. If I get an RFE asking for proof of a joint bank account (which we don't have), I'll scream bloody murder. The pols who passed the U.S. Defense of Marriage Act seemed to indicate, in their anti-gay fervor, that the purpose of marriage is to procreate, not to get a joint bank account.

I think it does make things easier when you have a child together. My opinion is based both on common sense and on the fact that, at my AOS interview, the officer told us to "make sure we included the baby's BC with our application when we file the I-751" because it is "very powerful evidence"...her words not mine.

The check just went trough today finally after almost a month of waiting so I don't know what to expect now.

Date for biometrics?

A new one year visa or what?

Does anybody has an idea??

I don't know if it matters, but it shouldn't. Some couples choose not to or can't have children. Good luck.

The point is not whether or not it matters, but you have to agree that when you have a child with someone, it is pretty strong evidence that the marriage was not a sham marriage with the sole purpose of circumventing immigration laws. That's all we are saying. :)

In my case I received a NOA extending my status for one more year after the expiration date of my residence and a couple of days latter an appointment for Biometrics...

Then just wait....... for an aditional request for Evidence, an interview or an approval.

I received the approval e-mail but have not received the Green card and I am worried, I was looking for information and if I haven't received it by June 10 I will have to apply a new form (i-90). :huh:

I hope your case is solved faster, and I also believe that the birth certificates are a very strong document in your aplication. Welcome to the waiting room !
