Unemployed and Federal Income Tax Return or Transcript

Hi all,

Me and my wife living oversea, My wife is usc and the petitioner for I-130 which is approved.

My wife is not working so we got joint sponsor her mother, now we are in NVC to upload documents, they ask federal income tax Return or Transcript for wife which she does't has and there is two choices : upload documents or not available. 

I am worry if i select not available they will reject.

 

Please i need advice.

Your wife a USC living overseas is required to file US income tax..  Even if she does not owe income tax she is required to file.  Thus you could try Not available with an explanation that she will/is filing back tax returns.

 I checked and it appears that she is NOT required to file if she does not have income from any source below a certain threshold... So you should be able to choose not available with an indication as to why not available
