Immigration Application - Domestic Violence Conviction

I need help! I petition my brother who is in the Philippines.  In gathering all his papers to complete the Immigration application, his NBI Clearance shows:  RECORD AS STATED
SLIGHT PHYSICAL INJURIES CC# XLII-104943 RTC QC (ON APPEALED)
Before it went to RTC - In the MTC court the case resolution is stated as follows:
XLII-104943 - accused decided GUILTY on April 28,2011

 (imprisonment of 15 days arresto menor in its medium period and to  pay the costs and to pay complainant nominal damages in the  amount of P3,000).  Appealed forwarded to RTC on June 22,2011
Is my brother's Immigration Application be rejected?

Is his Priority Date current? If so, you might want to consult an immigration attorney.

Yes, he is in the process of completing the IV application, I had told him to hold on because of that NBI Clearance notation.  

I did consult a VJ lawyer but told me domestic violence is permanently inadmissible.  I will consult other lawyers, but please anybody who had gone thru this, please share.  Thank you.

So he waited 20+ yrs for his PD to be current but he committed the crime of domestic violence during the intervening years?

 

I'm not being judgmental here. Just trying to get a picture of the situation.

Yes, it is really dumb. He was single, get married and went to Saudi Arabia to work and while he is in Saudi, his wife live with my mom and sister.  The wife keep on calling him about my sister being mean and abusive.  Upset, he came home, confronted my sister and therefore the fight ensued.  And court case followed.  Thanks for asking, it lighten me having express my feeling .
