Fees for i-485, i-765 and i-131

Hello!

 

I am currently working on my adjustment of status. I married my fiance shortly after I entered the US and now we are working on AOS.

I am currently 5 months pregnant with his child and have no plans to work (for the next 6-10months). Do I still need to file the I-765?  I'm a little confused by this.... Would the i-765 allow me to work while I'm waiting for my AOS to be complete?

 

The only thing I really care about at the moment is staying here legally and having the permission to leave the US to visit my family back home for a couple weeks, sometime next year.

 

Any advice?

You are not required to file an I-765 or I-131 at all. I suggest doing so in case you do want to work or travel abroad and return prior to getting a green card. ETA: ~4-6 months.

 

I-485 fee: 1140 + $85 biometrics = $1225. This should be paid together (i.e. don't neglect the biometrics payment, and it can be included in a single check/credit card/money order).

I-765: No fee when filed along with or due to an I-485.

I-131: No fee when filed along with or due to an I-485.

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

Thank you so much for this info! My I94 expires Nov 13th and my husband is concerned we are cutting it close. How long does it take for USCIS to send confirmation they've received I-485,I-765 and i-131? I'm hoping to have everything completed by the end of this week.... Are we really cutting it close?

You may or may not have the NOA1 in time, but USCIS goes by the date filed, not the date they put it into their system. So if it arrives before the 13th then you're fine (plus overstay is not a bar for AOS as the immediate relative of a USC).
