Tourist visa while married to US citizen with a kid

Good day,

I am married to a US born citizen since 2013 and we have a daughter together that I have never met physically before. I left 5 months after we married in 2014 because relationship didn’t work at the time. I have never applied anything related to immigration nor break any laws in US, also have never gone back either since 2014.

This year we started to talk again and we’d like to arrange a meeting for me to meet with my daughter. I will simply visit during my annual leave and come back to work. I have no intention to live in US.

Myself: I hold a work visa similar to H1B in Australia and work in a managerial position for almost 2 years but I am a citizen of Turkey. Also, I will start my master’s degree in March in one of the top universities here. These are my main ties to Australia and my parent live in Turkey. I have travelled to Netherlands, Austria, Greece, Germany and several others in East Europe in 2015 and 2016, NZ for a week in 2018. So, I have the travel history, too. Financials, character and health is also good.

My question: I am worried that my application gets rejected because of the strong ties to US, but at the same time I have never gone back nor applied permanent residency. I’d have done it by now if I wanted it. And even if I apply for green card it’d be through consular processing because I have commitments here.

What do you think about the chances and what should I do say to be convincing during visa interview?

You said you left after you married.  Where did you leave from?

 

If you are working on a contract or if your employer will indicate that you have a job to return to that would help with the ties to Australia. Include your master programs acceptance letter.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
