Ombudsman Request Expedite requirements

I filed for the Ombudsman because my n400 has been pending for over a year. i applied in July 2017 and interviewed in early October. However, a decision cannot be made. After several infopasses, congressman and online inquiries, i filed for the Ombudsman Expedite request.

Now, they are asking for more documentation. i did provide documentation showing that my case is way past processing times USCIS website shows that they are currently processing " September 30, 2017" cases.

I'm not sure what else to provide the Ombudsman for the expedite request. They also stated that if i do not provide the required documentation in a week, they will close my case. I'm not sure what that means.

Anybody have experience with that or what i can do?

Yoh should have gone to them in the first place.

5 years ago my gc was sent to a wrong address and returned back to uscis and i was assured would be resent to my correct address within 2 months time frame. Lasted over 6 months and lots of correspondences and calls! I got impatient and as soon as i filed with Ombudsman I also let the USCIS know i did it! Well they didnt like it but that did the magic and before Ombudsman even starts anything , with in a week gc was at my address.

Ombudsman is the absolute right path i would go through.

Ombudsman generally doesn't accept requests unless you have gone through the USCIS processes first (i.e. service requests).

You have wasted your time and energy on Ombudsman , if you have nothing to do. Go ahead and ask senator, and ombudsman for help.

USCIS hold upper hand on any govt entity, and they will not expedite your process for anything (Unless military related).

There is nothing you can do, but you are totally 100% on mercy of USCIS. Wait and your turn will come eventually when ever FBI decided to clear your name from name check.

If you have money in your hand, go ahead and sue them as well.

How have I wasted my time on ombudsman? I’d rather be proactive then sit and wait

did you visit USCIS(infopass)? did they told why it is still pending?they usually do not conduct interview if background check  is not completed.

did you request change name in the interview?

I have been to several infopasses....they are not straight with their responses. At times it’s pending adjudication...other times they say it’s pending security checks

That's weird!! they should not conduct interview for you if the  security checks were not completed and they  not do it  after the interview so its more likely  "pending adjudication" but all depend on your interview how did it goes?if there were specific questions ?

what also is weird you applied in July 2017 and interviewed in early October 2017 means you security check was completed within 2 months super fast so I believe you should not have issues with your security checks,do you mind if you tell me where are you from ?country?

Just as a note, these are not exclusive. Pending security checks means it is also pending adjudication...it's just a more detailed reason as to why it's pending adjudication.

Time to hire attorney because they have passed the 120 days to make decision after the interview

I actually have an attorney. He’s suggesting we file a lawsuit. But as you are aware that costs money. He said uscis can tell the judge that it’s pending background check and if the judge demands an answer they can make a decision which is possibly denial since the results from background check is not available

Did you had same issue (background check) took long to get your green card?

Correct. The attorney could file a Writ of Mandamus (WoM) to force USCIS to make a decision. However, they cannot force USCIS to make the decision you want. If they are pending background checks, forcing a decision must result in a denial if they are unable to complete the checks by the deadline granted by the WoM.
