For I-184 - Can i Use My Canadian Income??

Hi All,

 

Long time reader and first time posting. I am currently living and working in Canada for the better part of 5 years. I met my wife here and we are looking to move to the US together. We've filed the I-130 and it was approved. 

 

We are at the stage that says to show financial support. However, ALL my money and my assets (we bought a condo here in Toronto) are in Canadian dollars. AM I permitted to use my Canadian income to meet the poverty guidelines? I make roughly 70-80K CAD annually. Should I convert to USD? Do I list "0"?

 

Please help.

Only income that will continue from the same source upon return to the US can qualify for the I-864. You can use assets, though (which must be at least 3x the income level).

If this isn't your circumstances, then your I-864 income is $0. If it is the case, then the income would be your income converted to USD.

 

Also, you will need to establish US domicile (or show sufficient intent to do so) before the visa is issued. Canada is notoriously strict on this..usually requiring returning to the US for a few months to establish domicile first. Check out the Canadian portal using the links at the top of the page.

I also forgot to mention that I'm a US Citizen and that we would probably be looking to move to my parent's house for the time being until I find a job back home. If not, I could also try using my mother as a joint sponsor. She has no issue with that either.

If your mother meets the financial requirements, then sure she can be a joint sponsor (assuming she is a USC or LPR living in the US).

 

Having a place to live is good, but domicile entails more than just having a place to sleep.
