hi everyone i m new on here. we filed for marriage based AOS in january 2018. my spouse income didnt meet the poverty guidelines for a household of 2 so we used my assets to make up the difference as i have money in a savings account in my home country which was my inheritance. clearly the dollar equivalent of this funds makes up the difference. we got a 1st RFE in february that we needed to include assets with recent tax return and w2,1099 etc of my spouse. we did everything and also included a 12 month bank statement for proof of assets. now in july 2018 we got a 2nd RFE for the same thing asking for tax returns,proof of assets or use joint sponsor. the RFE said the assets were not enough when clearly they were way over the income shortfall. now we are confused on how to proceed.

Hello,

 

Most times USCIS does not like for assets and money from the beneficiary to be used to qualify and meet the poverty guidelines. Also, the fact that the money is overseas and not here in the US as part of your joint bank account or a savings account could be a reason why they are not accepting it. 

If you sent all the documents once and they are still asking for it, it means they are not satisfied.

So your best option is to find a friend, family member, I am not sure how close your spouse is to his/her parents,  to be a co-sponsor. They will have to fill out a form, I believe I-864 A (please don't quote me on this and double check, I read about it but haven't done it myself) and provide their tax returns.

Also, do you work yet? If you do, you can add on top of the co-sponsor, copies of your recent paychecks along with a letter of employment from your employer, stating your salary, how long you have been working there, number of hours worked per week, and that they intend to keep you there as long as possible.

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

If using a joint sponsor, they will complete their own I864 and provide all documentation required. 

 

It MAY be better if your assets were transferred to the US and in the joint account, but I am not sure wht will happen if you do this, resubmit and are then rejected..

 

Best and safest process is to get a joint sponsor.
